I. EXECUTION AND PERFORMANCE

1. we are committed to professional, careful, material-friendly and environmentally conscious textile care

.

2. the methods and practices customary in the industry are set out in the definitions published by the Swiss Textile Care Association (information sheet on practices)

.

3. the textile care professional may demand surcharges on the prices set out in the price list for special items (high-risk items, expensive and/or material-intensive items, etc.)

.

4. the number of items or quantities counted by the textile care company shall be decisive for delivery, return and invoicing

5. separate provisions apply to leased and rented linen.
 
II. RESPONSIBILITY
 
1. the prerequisite for liability on the part of the textile care provider is the durability of the articles when treated in accordance with the procedure recommended on the textile care label. In the absence of a textile care label, the textile care professional shall rely on his specialist knowledge and the intended use of the article; liability is expressly rejected in the absence of a textile care label.

2 Despite prior professional simple inspection of the goods, we cannot accept any responsibility for damage caused by an unrecognizable quality or hidden defects, such as insufficient strength of the material or seams, authenticity of dyes and prints, influences on buttons, buckles, zippers, underarm pads, appliqués, ornaments, ribbons, etc. or by incorrect textile care labelling. Liability for dimensional or color changes in the fabrics and knitted fabrics within the usual tolerance range is excluded.

3. the need for special treatment must be obvious; in particular due to detectable sensitive properties or soiling that require special treatment. The care symbols and/or care instructions on the textile care label are decisive for the textile care professional.

4. the textile care professional may accept the care order with reservations (so-called declaration of reservations)

5. the care order is established as an order within the meaning of OR 394 ff. A guarantee of success is excluded.
 
III. RETURN

1. we endeavor to meet the agreed delivery dates. However, delays shall not entitle the customer to claim damages.

2. the item will only be issued against cash payment and return of the order confirmation. In the case of large customers, invoicing shall take place in accordance with a separate agreement.

3. the items must be collected within six months of the order being placed. If the items are not collected within this period, the textile care provider may dispose of them without replacement. In the case of more valuable items, the textile care professional will send a reminder to the customer in advance, provided that the name and address of the customer are known. There is no obligation on the part of the Textile Care Professional to make inquiries in this regard.

4. If an order cannot be carried out, the item will be returned in the condition in which it was received.
 
IV. COMPLAINTS
 
1. complaints must be made without delay, at the latest within three working days of receipt of the item and must be accompanied by the receipt.

2. complaints will be carefully examined by the textile caretaker, answered or explained with reasons and the further procedure (proper re-treatment, handover for assessment and arbitration to the Joint Claims Settlement Body, etc.) will be determined in agreement with the customer if possible.

3. claims cannot be insured in the textile care sector in Switzerland. In the event of damage to the item or loss through the fault of the textile care provider, compensation will be paid in accordance with the current value table for the value of textile care items. Real compensation is excluded.

4. If no agreement is reached, we recommend that the parties submit the claim to the Joint Claims Settlement Body of the consumer protection organizations of the Swiss Textile Care Association (VTS) and the Association of Textile Retailers, Swiss Fashion Stores (SFS), for assessment and arbitration.
 
V. place of jurisdiction

1. place of jurisdiction for any disputes arising from the care order is the registered office of the textile care provider.
